"ALL ITEMS ARE SOLD AS IS WHERE IS"
THERE ARE ABSOLUTELY NO RETURNS, REFUNDS, EXCHANGES, OR LOT CANCELLATIONS UNDER ANY CIRCUMSTANCES.
Bidders are strongly encouraged to inspect all items prior to bidding. Failure to inspect does not relieve Bidder of responsibility for payment. G & A AUCTIONS, LLC and Seller make no representations or warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or condition. G & A Auction's, LLC will not guarantee that hours, model, or year listed on equipment to be original or correct and, furthermore, is not responsible for any discrepancies of advertised or announced hours, model, or year of equipment.
G & A Auction's will not be responsible for any damages caused by no antifreeze, lightening, or weather-related damages. Additionally, G & A Auctions, LLC is not responsible for any issues related to disruptions or failure of internet service.
All sales are final at the fall of the gavel.
Accepted Forms of Payment
Payment must be made in U.S. funds by cash, wire transfer, ACH payment, cashier's check, company check, personal check, or credit/debit card. G & A Auctions, LLC reserves the right to reject any form of payment.
A processing fee of 3.5% will be added to all credit and debit card transactions.
We will prosecute any unresolved returned checks.
$75 returned check fee applies
Buyer's Premium & Fees
Onsite buyers: 10% buyer's premium up to $1000.00
No buyer's premium $1001.00 or higher
Internet buyers: 10% buyer's premium capped at $2500.00
(Buyer's premium is calculated on the final hammer price.)

There is a $25/per day per lot fee for any items left 5 business days after auction day.
Upon acceptance of the final bid, title and risk of loss immediately pass to the Bidder. G & A Auctions, LLC and Seller shall have no responsibility for loss, theft, damage, or destruction of any purchased item after the sale. Upon gavel fall, item is sole responsibility of purchaser.
WARRANTIES DISCLAIMER
Buyer's participation in the auction and/or acceptance of the goods constitutes an express waiver of any and all warranties, including but not limited to those arising under Texas Business & Commerce Code §§ 2.312, 2.314, and 2.315 or any other provision of law.
THIS IS A SALE BY AUCTION, AND BUYER UNDERSTANDS AND AGREES TO THE FOLLOWING DISCLAIMERS:
NO WARRANTY OF TITLE AND AGAINST INFRINGEMENT:
G & A AUCTIONS, LLC ("SELLER") MAKES NO CLAIM OF OWNERSHIP: Buyer acknowledges and agrees that Seller does not claim to be the owner of the goods and is selling the goods solely in its capacity as a consignor, intermediary, or agent. Seller expressly disclaims any and all warranties of title, whether express or implied, and does not represent or warrant that it has the right to convey title to the goods. The sale is made without any warranty of title, and Buyer accepts the goods subject to any liens, claims, or third-party interests. Buyer assumes all risks related to ownership, title, and right of possession and agrees to hold Seller harmless from any and all claims, demands, or liabilities arising from or related to title or third-party claims.
NO WARRANTY OF MERCHANTABILITY:
Seller expressly disclaims any and all warranties of merchantability, whether express or implied, and does not represent or warrant that the goods are merchantable or suitable for ordinary use. Buyer accepts the goods "as is" and assumes all responsibility for determining the condition, value, and usability of the goods. Seller does not guarantee age, year, make, model, or condition of the goods being sold.
NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE:
Seller expressly disclaims any and all warranties that the goods are fit for any specific use or purpose, whether express or implied, even if such purpose is known to Seller. Buyer affirms that it has not relied on any oral or written statements, descriptions, or representations made by Seller in connection with the goods. All information in any advertising is from sources deemed reliable and is believed to be correct, but Seller shall not be liable for any errors in descriptions. All announcements made the day of sale take precedence over any printed material.
No item may be removed until paid in full and a paid invoice is presented.
G & A Auction's, LLC reserves the right to refuse to load/unload, move, or assist with any equipment, machinery, vehicles, trailers, or items that is deemed unsafe, unstable, overweight, defective, or otherwise hazardous.
Auction Load-out
Sunday thru Friday 8am to 5pm after Auction day. Any load out that occurs after the load-out week post Auction must only be made by appointment by calling the G & A Auction's Yard Manager at 979-616-7430. Office phone is 979-616-7416.
If any item is not removed within ninety days of purchase, G & A Auctions, LLC shall have the right, but not the obligation, to relist and resell the item in a subsequent auction. Bidder hereby authorizes Seller to act as Bidder's attorney-in-fact for purposes of transferring any right, title, or interest in the item.
G & A Auction's LLC reserves the right to:
Auctioneer's decisions are final.
Bidders may not conduct private sales, solicit business, or transact outside business on auction premises without written consent of G & A Auction's LLC. Violations resulting in damages shall subject Bidder to liability, including attorney's fees.
By bidding, Bidder acknowledges that they have read, understood, and agreed to these Terms & Conditions of Sale.

$301-$25,000.00 10%
$25,001.00 & up 8%
There is a minimum $10.00 lot fee
Seller acknowledges that the equipment delivered by Seller is free from liens
CONTAINER UNLOADING FEE:
Seller acknowledges that there is a $500.00 to $1000.00 fee for G & A Auctions, LLC to unload containers and equipment shipped within said container. Fee is contingent upon type of container and equipment shipped.
